The spouse of a deceased person is entitled to make a claim against their estate. It is therefore important for a testator going through or contemplating separation and divorce to update their estate plan.

The testator must update:

  • Will
  • Enduring Power of Attorney
  • Enduring Power of Guardianship
  • Advance Health Directive
  • Superannuation binding death benefit nominations
  • Life Insurance nominations
  • Considering severing any joint tenancies
  • The succession of any other of their entities
