An attorney can:
- handle the principal’s bank accounts
- sign cheques
- sign legal documents such as deeds and contracts including contracts for the sale of land
- sign land and property dealings, provided that the power of attorney has been registered at Landgate
- pay bills
- act as the trustee of a SMSF
- change BDBN
- apply for probate on behalf of an executor
An attorney can’t:
- make a will on behalf of the donor
- make personal, lifestyle or treatment decisions
- do any act which is illegal
- deal with any property held in trust by the donor
- perform the functions of a director or secretary of a company on behalf of the donor unless authorised by the constitution of the company
- delegate their authority
